Terms and conditions Lisa loves Lois

These Terms and Conditions are effective July 29, 2024.

Article 1: Definitions

• Lisaloveslois.com: sole proprietorship with limited liability Lisa loves Lois (Chamber of Commerce number: 82033676) trading under the name Lisaloveslois.com
• Participant: the contracting party of LisalovesLois.com to this agreement;
• Website: LisalovesLois.com
• Material: material provided by the participant for placement on the website, such as profile names, texts, photos and (chat) messages;
• Abuse: posting material on the website or sending messages via the website that violate the rights or privacy of others, sending unsolicited commercial information and spam, sending commercial SMS numbers, offering paid services, making offensive or insulting statements, impersonating someone else, infringing intellectual property rights or publishing or reproducing material without permission; -Free access: the use of the website whereby the participant is given access to the website and can make limited use of the services offered on the website;
• Premium Access: the use of a website whereby the participant is given access to the website and can use the services offered on the website that fall under Premium Access;
• Access type: indicates which services offered the participant can use on the website. This is for example Free access or Premium access;
• Subscription: the setting with which the participant indicates the amount Lisa loves Lois charges for the purchase of a paid access form per specific period. Depending on the chosen payment method, this subscription will be automatically extended. This happens when the period of the paid access form expires;
• Login code: the code provided to the participant by the website with which the participant gains access to the website.

Article 2: Agreement

These general terms and conditions form an integral part of every agreement concluded between Lisa loves Lois and the participant and apply to every offer and agreement.
Conditions that deviate from these general terms and conditions are only legally valid if they have been accepted in writing by Lisa loves Lois.
The agreement is concluded when the participant sends the registration form stated on the website to Lisa loves Lois via the website and this form has been received by Lisa loves Lois.
The agreement is personal and non-transferable.
Participation is only possible for persons aged 18 and over and only for women.

Article 3: Price and payment

The amounts stated on the website include 21% VAT.
The agreement regarding Free access ends with immediate effect upon cancellation by Lisa loves Lois or the participant.
The agreement regarding a subscription is entered into for an indefinite period and is extended until further notice. This agreement is concluded after receipt of the payment from the participant by Lisa loves Lois.
By completing the payment form on the website, the participant authorizes Lisa loves Lois to periodically debit the amount due from the bank account or credit card of the participant in the case of a subscription with automatic renewal. This depends on the chosen payment method and is also stated on the website in the explanation for the chosen payment method. If the amount due by the participant cannot be (fully) debited from the specified bank account or credit card after receipt of the payment form by Lisa loves Lois, access to the paid functions of the website will lapse.
If a payment by the participant is reversed (refunded via the bank), or if the automatic collection of the participant’s account or credit card has failed for another reason, this means that the participant is in default in fulfilling the payment obligation. This causes additional costs that Lisa loves Lois can charge the participant in addition to the principal amount. If payment is not made, Lisa loves Lois can call in a debt collection agency. In that case, the participant owes 15% of the principal amount with a minimum of € 40.00 in collection costs, in accordance with the Decree on Compensation for Extrajudicial Collection Costs. Before Lisa loves Lois calls in a debt collection agency, Lisa loves Lois will first send a reminder to the participant by e-mail. If prompt payment is not made, this reminder will also be sent by post to the postal address provided with the payment. If we have not received the outstanding amount within the set period, the claim will be handed over to a debt collection agency.
Lisa loves Lois may unilaterally adjust, extend or withdraw the rates of subscriptions or the right of access to the website associated with the access form.
Lisa loves Lois is entitled to index the agreed prices for current subscriptions effective 1 January of each calendar year in accordance with the consumer price index (CPI) published by Statistics Netherlands (CBS), series all expenditures. The changed price is equal to the applicable price as of 1 January, multiplied by the average monthly index figure (annual change CPI) over the previous twelve months for which the definitive figures are available from CBS at the time of indexation. Lisa loves Lois is entitled to apply a lower indexation amount in the context of indexation than the indexation amount that corresponds to the outcome of the aforementioned formula. Indexation will only take place for current subscriptions with a term of at least 180 days at the time of indexation.

Article 4: Right of withdrawal

The participant has the option to cancel the agreement regarding a subscription without giving reasons for at least 14 days, starting on the day the agreement is concluded (right of withdrawal).
The participant who exercises the right of withdrawal must inform Lisa loves Lois of this unambiguously, preferably via the contact form on the website. Because the participant has direct access to and can use the agreed services after the agreement has been concluded, the participant owes Lisa loves Lois a reasonable fee for these services in the event of withdrawal of € 1.50 for each day or part day that the agreement has lasted up to the moment of withdrawal, with a maximum of the amount that the participant has already paid in subscription fees to Lisa loves Lois at the moment of withdrawal. The amount owed as a result may be offset by Lisa loves Lois against the subscription fee already paid by the participant; any balance remaining after offsetting will be refunded to the participant.

Article 5: Right of use

Lisa loves Lois grants the participant the non-exclusive right of access to the website to view the data registered on the website.
The right of access referred to in the previous paragraph exclusively includes the right to use the website in accordance with the purpose for which the website was developed.
The participant is fully responsible for logging in to the website and using the login code provided to the participant by Lisa loves Lois.
The participant has no right to delivery or other provision of the login code, nor to transfer the right referred to in paragraph 1 of this article.

The participant will use the website exclusively lawfully and in any case refrain from:

using or attempting to gain access to computer systems and/or networks of others than oneself; investigating or testing the security of the website or networks of others than oneself; affecting the operation of the website or networks of others than oneself; alienating, renting or providing to third parties, using, changing, removing or rendering unusable for the benefit of third parties the data of others than oneself that is accessible by the right referred to in article 4.1; designing, producing, introducing and distributing computer viruses and other computer software that could possibly cause damage to the website; violating intellectual property rights and/or other rights of other users. Conduct of third parties who use the login code provided to that participant will be attributed to the participant as if that conduct were the conduct of the participant himself.

Lisa loves Lois has the right to temporarily or permanently deactivate the participant’s use of the login code without prior notice of default if the participant fails to fulfil any obligation towards Lisa loves Lois.

Article 6: Login code

The participant’s login code is secret. Lisa loves Lois and the participant will take reasonable measures to prevent others than the participant from gaining knowledge of the login code provided to the participant.
If Lisa loves Lois discovers and/or reasonably suspects that others than the participant are (able to) use the login code or if the participant informs Lisa loves Lois of such use, Lisa loves Lois will immediately block access to the website via the login code in question. Lisa loves Lois will inform the participant, to the extent necessary, of the unauthorized use and blocking of the login code and will provide the participant with a replacement login code as soon as possible after the blocking.

If the unauthorized use of a login code cannot be attributed to Lisa loves Lois, the participant must reimburse Lisa loves Lois for the administrative costs associated with the blocking and replacement, as well as the costs of the unauthorized use.

Article 7: Placement of material

The participant places material on the website at his/her own risk.

The participant shall refrain from posting profile names, texts and photos on the website that are offensive, racist or legally prohibited.

The participant shall refrain from placing material on the website that would allow other participants to contact the participant without using the contact methods specifically offered by Lisa loves Lois on the website. For example, the participant shall not place on the website his home address, telephone number, e-mail address or links to internet addresses where such data can be found. Indirect references or enticements to provide this data by other participants are also not permitted. The participant shall also refrain from placing on the website data referred to in the previous paragraph with regard to other participants.

Lisa loves Lois will remove the material referred to in the previous paragraphs without prior consultation with and notification to the participant or other participants. Violation of the above rules will be dealt with.

Lisa loves Lois may remove material that does not comply with the Lisa loves Lois guidelines without prior consultation and notification to the participant or other participants.

Article 8: Abuse

Lisa loves Lois may terminate the agreement with the participant with immediate effect in the event of misuse, make material inaccessible and/or remove it from the website, restrict the participant’s use of the services offered on the website and/or block access to the website without prior notice to or consultation with the participant.

In the event of termination of the agreement due to abuse, the participant is not entitled to a refund of the subscription fee already paid by her.

Lisa loves Lois is entitled, without further warning or notice of default and without the need for judicial intervention, to charge the participant an immediately due fine of € 1,000 (one thousand euros) per act of abuse, whereby the abuse of (personal) data, photos or other material and each message sent each counts as one separate act, without prejudice to the right of Lisa loves Lois to take further legal action against the participant and to claim damages, including for the repair of abuse caused by the participant.

Article 9: Data

The manner in which privacy is guaranteed is described in the Privacy and Cookie Policy.

The participant will indemnify Lisa loves Lois against all claims from third parties based on the assertion that data processed by Lisa loves Lois, the processing of data and/or the result of that processing are in conflict with applicable law.

Article 10: Liability

Lisa loves Lois is never liable for any possible (consequential) damage to the participant or third parties.

The participant indemnifies Lisa loves Lois against all claims by third parties for compensation for (consequential) damages related to this agreement.

If and to the extent that a Dutch judicial authority nevertheless rules that Lisa loves Lois is liable for the (consequential) damage of a participant or a third party and is obliged to compensate the damage in whole or in part, the amount of compensation will be limited to the subscription fee paid by the participant.

Article 11: Applicable law and competent court

This agreement is governed by Dutch law.

In the event of a dispute between Lisa loves Lois and the participant, the court shall have jurisdiction to hear the dispute or, at the discretion of Lisa loves Lois, the court that would otherwise have jurisdiction to hear the dispute.

Article 12: Changes to conditions

Lisa loves Lois has the right to change the terms and conditions and to declare the changed terms and conditions applicable to existing agreements, for which changes will take effect thirty days after notification to the participant.
